1. INTRODUCTION

Welcome to Perfekta Unlimited. This website is operated by Sebastián García, a U.S. citizen and independent service provider (“we,” “us,” “our,” or “Perfekta Unlimited”), accessible at www.perfektaunlimited.com. By accessing our website, placing an order, or subscribing to our services, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you do not agree with any part of these Terms, please discontinue use of our website and services immediately.

2. SERVICES

Perfekta Unlimited provides subscription-based and one-time graphic design services for event promoters, DJs, and nightclub owners. Services include, but are not limited to, event flyers, motion flyers, LED visuals, Instagram content, and related digital design assets (“Services”).

3. USE OF ARTIFICIAL INTELLIGENCE TOOLS

3.1 AI-Assisted Creation. Perfekta Unlimited uses artificial intelligence (AI) tools in the creation, modification, enhancement, transformation, and generation of visual content. This includes, but is not limited to, AI-assisted image generation, image editing, background removal, upscaling, style transfer, and the creation of composite or derivative works.

3.2 Use of Client-Provided Materials. When you submit photographs, images, or visual assets — including images of real individuals — as source material for a project, those materials may be processed using AI tools to produce the requested creative deliverables.

3.3 Client Acknowledgment and Consent. By subscribing to or purchasing Services from Perfekta Unlimited, you expressly acknowledge and consent to the following:

(a) The use of AI tools in the creation, modification, enhancement, transformation, and generation of visual content as part of the Services.

(b) The submission and processing of photographs, likenesses, names, event details, venue information, business information, and any other materials you provide (“Client Materials”) for the purpose of delivering the requested Services.

(c) The creation of derivative works, AI-enhanced images, AI-generated content, edited images, and composite works based on Client Materials.

(d) That you represent and warrant that you hold all necessary rights, permissions, licenses, model releases, and consents required to submit any images, likenesses, logos, trademarks, copyrighted materials, or personal information for use in a project, and that such use does not infringe upon the rights of any third party.

(e) A release and waiver of any claims against Perfekta Unlimited arising from the authorized use, modification, enhancement, transformation, or AI-assisted processing of Client Materials, except where prohibited by applicable law or in cases of gross negligence or willful misconduct on the part of Perfekta Unlimited.

4. CLIENT MATERIALS AND DATA

4.1 Scope of Use. Any information, photographs, business names, event details, personal data, or other materials you provide will be collected, stored, and used solely for the purpose of delivering the requested creative Services and communicating with you in connection with those Services.

4.2 Third-Party Tools. In the course of providing Services, your materials may be processed using third-party software platforms, AI services, cloud storage providers, and project management tools. We take reasonable steps to use reputable third-party providers and do not authorize those providers to use your materials for any purpose other than enabling us to deliver our Services.

4.3 Confidentiality. We will not sell, rent, or disclose your Client Materials or personal information to unaffiliated third parties without your prior written consent, except as required by law or as necessary to perform the Services.

4.4 Data Retention. We may retain Client Materials for a reasonable period after project completion for the purposes of quality assurance, dispute resolution, and service continuity. You may request deletion of your materials by contacting us in writing at info@perfektaunlimited.com.

4.5 Privacy Policy. The collection and use of personal information is further governed by our Privacy Policy, available at www.perfektaunlimited.com/privacy-policy, which is incorporated into these Terms by reference.

5. INTELLECTUAL PROPERTY AND OWNERSHIP

5.1 Ownership of Deliverables. Upon receipt of full payment, you retain ownership of the final design files delivered to you as part of your subscription or purchase.

5.2 Portfolio Rights. By default, you grant Perfekta Unlimited a non-exclusive, royalty-free license to display completed work in our portfolio, website, and social media channels for promotional purposes. To opt out of this license, notify us in writing at info@perfektaunlimited.com prior to or at the time of your design request.

5.3 Client Responsibility. You are solely responsible for ensuring that all materials, images, trademarks, logos, and other assets you submit do not infringe upon the intellectual property rights of any third party. Perfekta Unlimited assumes no liability for claims arising from materials submitted by the client.

5.4 Stock and Licensed Assets. Stock photography or media incorporated into designs is licensed for the specific use case only. Standalone licenses for individual stock assets are not transferred to the client unless separately arranged.

6. USE OF DESIGNS FOR RESALE AS TEMPLATES (HOTCLUBFLYERS.COM)

6.1 Template Resale. Perfekta Unlimited may adapt, modify, and resell designs created for clients as editable PSD templates through our affiliated platform, HotClubFlyers.com. Templates derived from client work are modified prior to resale to remove or replace identifying information, including but not limited to event names, dates, venue names, and any photographs of real individuals originally provided by the client or used in the original design.

6.2 Modification of Likeness. Where a design incorporates a photograph of a real person, that photograph will be replaced with a different image prior to the design being listed as a template for resale. Perfekta Unlimited will not resell any template containing a recognizable likeness of any individual from the original client project without first obtaining separate written consent from the rights holder.

6.3 Client Acknowledgment. By subscribing to or purchasing Services from Perfekta Unlimited, you acknowledge and agree that the underlying design layout, composition, color scheme, and structural elements of your project may be adapted into a generalized template for resale on HotClubFlyers.com or affiliated platforms, subject to the modifications described in Sections 6.1 and 6.2 above.

6.4 Takedown Requests. If you believe a template available on HotClubFlyers.com is derived from your project and you object to its continued availability, you may submit a written takedown request to info@perfektaunlimited.com identifying the specific template. Perfekta Unlimited will review the request and, where reasonable, remove or further modify the template within a reasonable timeframe. Takedown requests do not affect the validity of the original design deliverables or your subscription.

7. SUBSCRIPTION AND BILLING

  • Subscriptions are billed monthly based on your selected plan.
  • Subscriptions renew automatically each month from your start date.
  • You may cancel at any time; cancellation takes effect at the end of the current billing cycle. No refunds are issued for partial billing periods unless covered by our Satisfaction Guarantee.
  • Perfekta Unlimited reserves the right to modify pricing with reasonable advance notice.

8. SATISFACTION GUARANTEE

Perfekta Unlimited offers a 14-day satisfaction guarantee from the start of a new subscription. If you are not satisfied with the quality of Services within this period, contact us at info@perfektaunlimited.com to discuss a resolution, which may include additional revisions or a full or partial refund at our discretion.

9. TURNAROUND TIME

Perfekta Unlimited aims to deliver completed design requests within one business day. Turnaround times may vary based on complexity, revision volume, or active request queue. Business hours are Monday through Friday, 9:00 AM – 6:00 PM EST. We are closed on weekends and public holidays.

10. REVISIONS AND APPROVAL

Revisions are included as part of your subscription plan up to the limits specified on the pricing page. Once you approve a final design, Perfekta Unlimited is not responsible for errors or omissions discovered after approval. It is your responsibility to review all deliverables carefully before approval.

11. DISCLAIMER OF WARRANTIES

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Perfekta Unlimited does not warrant that the Services will meet all of your specific creative requirements or that deliverables will be free from errors.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Perfekta Unlimited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our Services. In any event, our total liability to you for any claims arising out of or related to these Terms or the Services shall not exceed the total fees paid by you to Perfekta Unlimited in the three (3) months preceding the claim.

13. DMCA AND COPYRIGHT COMPLAINTS

We respect the intellectual property rights of others. If you believe that any content on our website or in our deliverables infringes a copyright you own, please submit a written notice to info@perfektaunlimited.com including: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location; (c) your contact information; and (d) a statement of good-faith belief that the use is unauthorized.

14. TERMINATION

Perfekta Unlimited reserves the right to terminate or suspend access to our Services at any time, with or without prior notice, if you violate these Terms, engage in fraudulent activity, submit materials that infringe third-party rights, or engage in conduct deemed harmful to our business or other clients.

15. MODIFICATIONS TO TERMS

Perfekta Unlimited reserves the right to update these Terms at any time. Continued use of our Services after updated Terms are posted constitutes your acceptance of the changes. We will make reasonable efforts to notify active subscribers of material changes via email.

16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Services shall first be addressed through good-faith negotiation between the parties. If negotiation does not resolve the dispute within thirty (30) days, both parties agree to submit the matter to binding arbitration under the rules of the American Arbitration Association (AAA), with proceedings conducted remotely. Each party shall bear its own legal fees unless the arbitrator determines otherwise. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction where necessary to protect intellectual property rights or confidential information.
